It sounds like what is happening is the disk is catching on the piece that you are talking about in the fourth pic. This part moves up when the disk is loaded sandwiching the disk between it and the piece from your fifth pic., and keeping the disk clear from the tray while it spins. What seems to be happening is the part is not moving back down fully, so leaving the case partially separated allows the extra clearance needed for the tray to eject properly. I am assuming that you've taken the drive apart and have had the problem since then. Try taking it apart again and make sure that everything is in it's proper place, clean, and properly lubricated.
